Terms and Conditions.

Terms and Conditions.

Camp Summers is an intercultural work programme. The purpose of our programme is to give young people the opportunity to share experiences, making new friends and meeting people from all over the world, including staff and “campers” (boys and girls who attend the camp) from the United States.

The programme is run through our partners in the United States and designated J1 sponsor providers IENA (International Exchange of North America) and other possible sponsors authorised by the US Department of State. During the period of work at the summer camps, your employer will be the Camp that made you the job offer or contract. Camp Summers is never the employer, as our role is to provide the support, documents and information needed for your sponsorship. Neither Camp Summers, nor IENA, nor any other sponsor owns the camps that do the hiring.

Camp Summers USA and its partner in Spain ACEspaña Working Abroad SL provide consultancy and human resources recruitment services for summer camps in the United States. Once the employment contract has been obtained and the applicant has been sent the corresponding documents needed for the J-1 visa, the applicant is responsible for any circumstance outside Camp Summers’ control that may result in their employment contract not being secured. The visa application at the embassy and its costs will be borne by the applicant; in the infrequent case of refusal by the US embassy, a state of war, a pandemic, a state of emergency, withdrawal by the applicant or withdrawal by the camp, there will be no obligation for any refund from Camp Summers USA or its partner in Spain.

The purpose of the terms and conditions set out below is to detail specifically the rights and obligations of both the participant and the company, Camp Summers.

Participants in the Camp Summers programme may fall into the following categories:

First timer applicants

(participants joining the programme for the first time) – Camp Summers will help the participant with registration, documents and the information needed for their hiring and sponsorship. Participants who have previously worked at a camp but want to work at a different camp will be considered “first timers”.

Returner applicants

(participants returning to the same camp) – “Returners” are those who have already worked at a camp in the United States on a J1 Visa and want to return to the same camp. The “returner” will be responsible for contacting, talking to and negotiating the terms and conditions of their position directly with the camp. To return, the participant will need a letter of invitation or a contract from the camp. Camp Summers will limit itself to carrying out the information and documentation process needed for their sponsorship.

Direct placements

(direct placement at a camp) – refers to “first timers” who have a prior contract with a camp, which they found and secured themselves. Camp Summers will limit itself to providing the information and documents needed for their sponsorship.

**AC ESPAÑA Working Abroad SL expressly reserves the right to require the participant to pay the difference corresponding to the second payment (sending the application to the USA) if there is a delay in sending the profile to the United States attributable to the participant.

Refunds and cancellation.

When the participant registers for the Camp Summers programme and pays their fees, the participant is paying for the Camp Summers service. The Camp Summers service consists of the guidance, information and documents needed from the start of the process until they are hired by a Camp. In addition, Camp Summers will help the participant with the process of requesting the J-1 Visa appointment. Camp Summers is not responsible for how each camp operates, for the participant’s travel or for changes of decision by a camp or the US Department of State regarding hiring.

“First timer” participants

If you are a “first timer” and decide to cancel the programme, the following situations may arise. Please remember that each payment relates to one of the phases. As each phase is completed, that payment is confirmed (it has been used).

PhasesWhat happens?Payment
Phase 1 payment (application and interview)The payment is kept for the following season. There is no option of a refund for the phase 1 payment.29/39/49€
Phase 2 payment (sending the application to the United States)If they have already been hired and cancel the programme: no refund. It is not kept for the following seasonIf they have not yet been hired and cancel the programme: the payment is kept for the following season. If they stay in the process until the end of the hiring period set by Camp Summers (1 June) and have not received a contract offer: the participant will receive a refund of the phase 2 payment. The refund is subject to an administrative fee of €5.Camp Summers reserves the right to withhold the refund if:– The participant repeatedly fails to reply to Camps when they try to get in touch for an interview.– The participant turns down 5 or more camps. 100/110/120/150/200€
Payment 3 (hiring and confirmation)If they cancel the programme after making all three payments: the participant would lose the payments made, except the phase 1 payment (kept for the following season)200€

Important.

*i. Application payment 1 is never refunded, as it covers registration, information and the interview

*ii. Payment 2 will only be refunded if the participant has stayed in the process until the end of the hiring period (1 June), has not received a contract offer by the deadline of 1 June and has taken an active part in their hiring.

*iii. The participant will lose the option of a refund of the phase 2 payment if they withdraw from the process, even if they can return to it later in the season.

*iv. Payment 2 will not be refunded if Camp Summers has got the participant hired and the participant turns it down and wants to return to the job pool (Camp Summers USA would already have fulfilled its part: finding a placement for the participant).

*v. If the participant does not reply to the camps interested in their profile, they lose the option of a refund of the phase 2 payment.

*vi. Camp Summers is not responsible for payments made to third parties: criminal records, the embassy, flights and transport costs.

*vii. The payments made to Camp Summers vary depending on the date on which the programme is started and the payments are made.

  1. If the participant has not received an offer by 1 June, the second payment will be refunded to the participant during July, or they will have the option of keeping all their payments for the following season at no additional charge. 98% of participants on our programme receive at least one job offer for the summer.
  2. If the participant turns down a placement offered by a camp, returns to the job pool and does not receive any other offer, the participant will lose the right to a refund of the second payment. The first payment would be kept for the following season. Camp Summers’ commitment is to offer participants at least one job offer. If they turn down that job offer and do not receive any other, the participant would lose the second payment made.
  3. If the participant is not happy with the camp that has been reviewing them, they must let Camp Summers know as soon as possible. Camp Summers will work with the “visa sponsor” to try to move their profile and placement to a different camp.
  4. If the participant has made the second payment and their application has been sent to the United States, and after that they decide to leave the programme, Camp Summers will not make any kind of refund, but will keep the payments made for the following season.
  5. If the participant is dismissed by the camp or chooses to leave before the end date of their contract, they will lose all rights to a refund. In some cases, and if the reasons are not objective, they will have to pay the Sponsor’s costs for their hiring, up to $1,600. Payment must be sent to the Sponsor within the following 30 days.

  2. If you need to notify us of a cancellation of the programme, please call Camp Summers or send an email to info@campsummersusa.co.za with the subject Camp Summers Cancellation.
  3. If a member of your immediate family suffers any kind of emergency or life-threatening accident before you leave for the United States, the participant’s payments will be kept. Camp Summers will require a medical certificate as well as the return of the DS2019 document.

Payments made to Camp Summers are for the information, support, documents and processing of their sponsorship. Camp Summers is not responsible for any situation that prevents the fulfilment of their contract and is beyond Camp Summers’ control.
  7. If the participant is unable to travel or complete their contract for any reason described in the previous point and has made all their payments, Camp Summers will give the participant the following options:
    • Use of their application and payments during the following 2 seasons.
    • Transfer of the application and payments to another participant (the new participant must pay the phase 1 administration fee, €49). If the participant has made payments 1 and 2 of the programme, the new participant will only need to make payment 3.

By making the payment or payments to Camp Summers and accepting the terms and conditions, the participant will be bound by the terms set out in this document.

These terms and conditions are governed by the law of the Government of Spain. If the participant wishes to bring legal action, it will be resolved in the relevant courts.
